By accessing our website or placing an order, you accept these Terms and Conditions and our Privacy Policy.

Birchen Grove Garden Centre may

  • update or change the website without notice
  • change these Terms and Conditions at any time

Continued use of the website means you accept any updated terms. If you do not agree with any part of these terms, you should not use the website or place an order.

Product descriptions

We take care to ensure product descriptions, images and prices are accurate. If an error is discovered after you place an order, we will contact you to confirm whether you wish to continue or cancel the order.

Each product is sold subject to its description, including dimensions, colours, delivery notes and any guarantees.

Making a purchase

Browsing and ordering online is straightforward.

After placing an order, you will receive an acknowledgement email. This is not acceptance of the order.

Acceptance occurs when we send an Order Acceptance email confirming that your items are being processed and despatched. At this point a contract is formed.

If we cannot accept your order, we will notify you.

Payment

Payments are processed securely through our online payment provider. All major credit and debit cards are accepted.

Prices are shown in pounds sterling and include VAT. Delivery charges are shown at checkout.

If your card is not authorised, you will be asked to provide an alternative payment method.

Substitute products

If an item becomes unavailable, we will contact you to offer a suitable substitute.

  • If the substitute is not suitable, we will refund the item
  • If you accept the substitute and later find it unsuitable, we will refund it along with delivery charges once returned

Returns and cancellations

Your rights are protected under UK consumer law.

If you have had your items delivered, you may cancel your order before or up to eight days after delivery. Items must be returned unused, complete and in a resalable condition with original packaging.

To cancel an order, you may

  • bring the item to Birchen Grove Garden Centre with proof of purchase
  • email our customer service team
  • phone us
  • write to us at our customer service address

A full refund will be issued. If you return the item directly to the centre, there is no charge. If using another method, you may need to cover return costs.

We cannot accept cancellations for

  • items returned without proof of purchase
  • personalised or made to order goods
  • perishable items such as cut flowers
  • opened CDs, DVDs or software

Flower orders can be amended or cancelled until 12 noon on the day before the scheduled delivery date.

Faulty goods

If a product develops a fault within twelve months of purchase, we will offer a repair, exchange or refund with proof of purchase.

Faults caused by misuse, neglect, accidental damage or normal wear and tear are not covered. Perishable goods are excluded.

  • by phone
  • by writing to our customer service address

Limitation of liability

Birchen Grove Garden Centre is not liable for losses arising from

  • loss of business or income
  • loss of data
  • loss of goodwill or reputation

We do not guarantee that the website will operate without interruption or errors, nor that it is free from viruses.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence.

Severance

If any part of these Terms is found to be unlawful or unenforceable, that part will be removed and the remaining terms will continue to apply.

Applicable law

These Terms are governed by English law. By using the website you agree to comply with all applicable laws and regulations.

Birchen Grove+ Membership

Birchen Grove+ is an application that allows customers to enter their personal information as a requirement of joining the membership scheme. In addition, the customer is asked accept/reject:

  • The receipt of marketing information via various specified media.
  • Their purchasing habits being captured and used for target marketing
  • Their personal information being passed to a third party for marketing purposes.

The Birchen Grove+ application can only be used in conjunction with Birchen Grove Garden Centre systems. None of the data captured is stored within the application or on the ‘capturing’ device.

All the information gathered is passed securely to Birchen Grove Garden Centre for storage and processing.

How to Delete Your Birchen Grove+ Member Account

In-App Steps to delete your APP account:

Step 1: Log into the app

Step 2: Go to the Account icon

Step 3: Select the Details tab at the top

Step 4: Scroll to the bottom and tap ‘Permanently Delete Account’

Step 5: Enter App password, and tap delete.

Your customer record is immediately permanently deleted.

Steps to delete your Account if you have deleted your App:

Email info@polhillcentre.co.uk with your customer number to advise you would like your account to be deleted.
